Ohio Senate Bill 246 - Student Removal

To enact the "SAFE Act" to revise the procedures for emergency removal of a student, to prohibit certain suspensions and expulsions of students in grades pre- kindergarten through three, to require each public school to implement a positive behavior intervention and supports framework in accordance with state standards, and to make an appropriation

SUMMARY:

  • Limits how and when schools may issue an out-of-school suspension for students K-3.
  • Changes the timeline for when a hearing is to occur from three (3) days to the day after a removal.
  • Requires principals to consult with mental health professionals prior to suspension or expulsion.
  • Establishes new requirements and instruction for teachers including positive behavioral intervention.
  • Requires schools to implement a positive behavior intervention and support framework.
  • Provides the Ohio Department of Education oversight of the implementation of these provisions by school districts.
  • The language from this bill was amended into HB 318.
